“When I graduated from law school, practicing law was the last thing on my mind.  I was fortunate to meet a number of outstanding individuals — some significantly more experienced that I was — who were kind, strong, wise, fair-minded, lived balanced lives, contributed significantly to their community and were financially comfortable.  They had one other thing in common:  all were lawyers running smaller practices.   Eventually that made a lot of sense to me.  This fall is our 16th anniversary.”

“I read this in a business book, probably long before I went to law school.  The more important term in the contract isn’t in the contract; it’s dealing with people who are honest.”

“We served as counsel to our seller/developer client in the construction and sale of two office buildings that are now the corporate headquarters for Australian toy company Moose Toys. In another matter, a Japanese company retained our firm to form its U.S. subsidiary for #JapanHouse Los Angeles—a global project to promote Japanese culture, art, food, technology and fashion ahead of the Tokyo 2020 Olympic Games.”

“I’m really proud of the team. We have a well-educated mix of Boomers, Xers and Millennials. Many have advanced degrees or even multiple advanced degrees. They work hard to deliver for our clients. A majority of them call the South Bay home.”

CHRISTOPHER ADISHIAN ’87

Like many Chadwick alumni, Chris Adishian ’87 vividly recalls outdoor education. He went rock climbing at Joshua Tree National Park, made two weeklong camping trips along the Colorado River, camped and hiked on Catalina Island, and participated in a “home and away” exchange with a private school in Connecticut.

“These are just tremendous learning experiences for young students that stay with them for a lifetime,” Adishian says. “I still remember mine over 30 years later.”

But more than just for the fun of being outdoors, Adishian appreciates Chadwick’s outdoor education program for what it brings to each student’s sense of being.

“Chadwick’s commitment to educating the whole child is rare,” he says. “I believe it helps each child discover and develop his or her confidence, perspective, abilities, interests and potential.”

As a student, says Adishian, he “seemed to be always playing sports either during or after school.” He rowed during his freshman year at the University of California at Berkeley, and still takes yoga and martial arts classes every week. His other exercise, he says, comes from wrestling with his two children, Mark (4) and Talar (2). Adishian resides in Hawthorne with his wife Lena, and their children.

“My hope is that I can contribute my skills to help Chadwick achieve its short- and long-term goals…”

For Adishian, time out for fun and family can be hard to find. He balances his workdays between his legal practice, where he focuses on business, real estate and employment law (he earned his J.D. from Loyola Law School in Los Angeles), and his real-estate firm, where he manages approximately $33 million in residential and commercial property and makes good use of his B.A. in Mathematical Economics from UC Berkeley.

As busy as he is, Adishian suddenly felt like a man with time on his hands when Chadwick approached him about a trusteeship.

“Chadwick was such a positive, growing experience for me in so many ways,” he says. “When I was asked to join the board, it seemed like the natural thing to do.”

As an experienced world traveler, he admires the school’s global perspective, especially the opening of the campus in Songdo, Korea. “When I first heard about Chadwick International,” he says, “my first thought was, ‘That is simply brilliant!’ What a visionary idea.”

Now it’s his turn to help form the vision for Chadwick’s future. “My hope,” he says, “is that I can contribute my skills to help Chadwick achieve its short- and long-term goals so the school can continue to fulfill its mission for the students at Chadwick School and Chadwick International.”

Former NFL player Eric Sutton sues Wal-Mart Stores, Inc.:  Suit Highlights Racial and Age Discrimination, Harassment, Wrongful Termination, and Failure to Pay Wages at world’s largest retailer and world’s largest employer

EL SEGUNDO, CA (November 12, 2014)– Eric Sutton, an over 40, African-American, filed suit this month in Los Angeles Superior Court against Wal-Mart Stores, Inc., the world’s largest retailer and the world’s largest employer.   Eric, a former professional football player, played in the NFL for the Washington Redskins, Philadelphia Eagles and Oakland Raiders and the CFL for the Saskatchewan Roughriders and the Calgary Stampeders.

According the suit, prior to his termination, Eric was employed as an Asset Protection Manager at Wal-Mart and earned great reviews.  Eric was one of only 5 or 6 African Americans holding the title of Asset Protection Manager out of approximately 100 such positions in his region.  He was also one of the oldest.  Eric had interviewed to move from Asset Protection to a Shift Manager position.   When they discovered his intention to move outside of Asset Protection to the Store Management track, his white supervisors “questioned him as to why he had …applied for the position of Shift Manager.”

The Complaint goes on to allege that on September 30, 2014, a shoplifting suspect attempting to flee the store pushed one of Eric’s security team members, started a brawl and proceeded to make threats against Wal-Mart employees, including “physically attacking the guards and biting one of them.” Eric “called the South Gate Police Department and advised his three security team members to disengage”, but the shoplifter continued to fight until “the arrival of the South Gate Police Department Officers.”

As alleged, an all-white management team conducted a purported “investigation.”  The suit goes on to allege that during this purported “investigation” one of the white managers “demanded that her subordinates…alter their statements to falsely state that Plaintiff did NOT tell his team to disengage.”    Wal-Mart fired Eric with none of the standard progressive discipline – despite a history of positive performance reviews — replaced him with a “younger, white individual” and further violated California Labor Law by failing to pay Eric all amounts due to him on the date of his termination.

“Eric was a model employee, and apparently even truthfully testified for Wal-Mart, Inc. in some of its union related matters.  It appears that this Wal-Mart store is out of control, and the stated reason for Eric’s termination is just a pretext.  We’re eager to commence formal discovery,” states Chris Adishian, attorney at Adishian Law Group.

The lawsuit, filed in Los Angeles Superior Court, alleges discrimination, harassment, wrongful termination, and failure to pay wages and  seeks damages for lost wages, benefits and career opportunities, emotional distress, special damages, punitive damages, and attorneys’ fees and costs.  Wal-Mart has since removed the case to the United States Federal District Court, Central District of California in Los Angeles.  Click here for a copy of the Complaint.

EL SEGUNDO, CA (October 6, 2011)—Chris Adishian, President of the Adishian Law Group in El Segundo, CA and an expert in employment law was recently quoted in an article appearing in Lawyers.com regarding a case where workers who quit were still eligible to receive unemployment benefits.

In most states, in order to be eligible for unemployment insurance, the employee must be fired for other than gross misconduct. Typically, employees who quit their job for a reason other than good cause created by the employer are ineligible for unemployment benefits.  However, the article points out, in practically every state a worker who voluntarily quits for a good reason or good cause created by the employer, can get unemployment benefits.  Good cause generally includes, intolerable or detrimental working conditions. Says Adishian, “It’s similar to the test often used in constructive discharge cases.  In California, the test for a constructive discharge is generally stated as whether a reasonable person in the employee’s shoes and faced with the alleged intolerable conditions would have felt compelled to resign.  A constructive discharge is the legal equivalent to a termination or firing.”  Explains Adishian, “Intolerable conditions may include instances when an employer creates false requirements in order for an employee to keep her job; or a supervisor continually yells and screams unfair and harsh criticism along with threats of termination; or an extended campaign intended to get an employee fired.”  Adishian advises that the factors to be considered include demotion, salary reduction, reduction in job responsibilities, reassignment to menial work, reassignment to work under a more junior person, employer harassment and even offers of retirement or continued employment on less favorable terms.
